PREVENTION AND FIGHTING IN THE PERIOD 2016-2020

I. THE NEEDS OF PROGRAM CONSTRUCTION

Prostitution is a difficult social problem not only in Vietnam but also in almost every country in the world. Prostitution, prostitution-related crimes such as containing prostitution, prostitution brokerage, buying sex with minors, especially trafficking for the purpose of prostitution cause many complicated problems. for society, public health, causing publicfrustration.

According to the current law, prostitution is a violation of the law, however, in terms of society, sex workers are a vulnerable group (being abused, violated, or abused. products, being exploited, infected with sexually transmitted diseases, discriminated against, and unable to access health and social services).

The program of action to prevent and combat prostitution in the period 2011 - 2015 has achieved certain results, but there are still many difficulties, challenges and shortcomings. Prostitution is still complicated; There is a lack of appropriate policies and programs for active intervention, especially harm reduction, violence prevention and job change support for sex workers. On the other hand, the prevention of prostitution is an activity that requires inter-agency coordination, with a clear assignment of functions and tasks of ministries, branches and localities, in which clearly defining roles, responsibilities of the leading agency, coordinating agency and the responsibility of the government at all levels. There should be a coordination mechanism to promote cooperation between domestic and foreign partners; mobilizing the participation of the whole political system, international organizations, social organizations and the people in prostitution prevention and control.

Therefore, it is necessary to have measures and solutions to prevent the increase and then reduce prostitution; reducing the harmful effects of prostitution on the life of the community and to the sex workers themselves; Supporting sex workers to integrate into the community requires solutions to ensure their basic rights, facilitate them to access information, improve their knowledge and skills for them to access private services. reproductive health care and counseling, as well as other basic social services, especially create opportunities to find jobs and stabilize a life in social integration.

II. FACILITIES FOR PROGRAM CONSTRUCTION

2. Practical basis

a) Current situation of prostitution

According to reports from 63 provinces and centrally-run cities, currently, the number of sex workers with management records is 11,240 people, of which, concentrated in some areas such as: Red River Delta: 3,673 people ; Northeast: 913 people; North Central: 887 people; Southeast: 3,200 people; Mekong River Delta: 1,374 people; 1,189 people in other areas. However, the actual number may be even higher since this is a difficult activity to control due to its complexity, sophistication and disguise.

New types of prostitution activities and subjects are emerging: call girls, sex tourists, foreigners selling sex, male sex workers, gay sex workers, transgender sex workers, online prostitution brokers internet, facebook, ... The situation of sex workers using drugs tends to increase; sex buyers of many different ages and groups, including those who have no stable jobs, are self-employed: 75.7%, enterprises: 20%, officers, employees: 3 %; 80% of owners, brokers are from 18 to 25 years old; Over 40% of the owners are women. In cities, the re-emergence of prostitution spots in public areas, adversely affecting the cultural environment, fine customs and traditions, affecting social order and safety, causing frustration in public opinion.

Prostitution has caused many consequences for society: The risk of spreading social diseases, HIV / AIDS through sexual contact due to unsafe sex (rate of people infected with HIV through sex every day increasing (45.3%, accounting for the highest rate among other transmission routes); prevalence among men who have sex with men is 3.9% (up nearly 2 times compared to 2012) Sex workers often suffer from violence, appropriation of property, money, sexual exploitation; discrimination, alienation, and difficulty in accessing social services ...

Prostitution has also increased gangs, organized crime of buying and selling drugs, organizing illegal drug use, human trafficking, and organizing prostitution activities in some localities. Establishing the lines of trafficking for the purpose of prostitution ...; The situation of trafficking in women and children for the purpose of prostitution tends to increase not only domestically and internationally.

b) Existence and limitations

- In some localities, the government has not really paid attention to the prevention and control of prostitution; has not yet drastically and continuously directed the fight against crimes and acts of violation of the administrative law related to prostitution, leading to the existence of organized crime venues and nests. public prostitution activities, challenging public opinion; Many provinces and cities have not yet established and consolidated the interdisciplinary inspection team for prostitution prevention and control at all levels, so the results of inspection, examination and prevention are still limited.

- Communication on prostitution prevention and control has not been carried out regularly; The new content only focuses on reflecting the current situation of prostitution; has not focused on harm reduction propaganda and stigma reduction. The capacity of the contingent of reporters, communicators and collaborators on prostitution prevention and control is limited in quantity and quality.

- The operation of pilot models of harm reduction and support for sex workers is still simple, mainly through propaganda, communication, group activities, clubs; There has not been a system of specialized support services that is easily accessible to sex workers and victims of sexual exploitation.

- The workforce of grassroots prostitution prevention and control cadres is now mostly part-time, reducing the effectiveness of the prevention and control of prostitution in the locality.

- Low investment budget for prostitution prevention and control; Many provinces and cities do not allocate local budgets, only use support from the central budget; The limited budget is not commensurate with the assigned tasks, so many tasks are integrated or implemented in a short time so the effectiveness is limited.

c) Problems raised in current prostitution prevention and control

Cognitive problems
+ The views and awareness of prostitution prevention and control of some committees and local authorities have not been unified, so the implementation is not determined and radicalized, leading to the existence of clusters and groups criminals organize public prostitution activities, challenge public opinion.

+ A part of the population and young people today, due to inadequate awareness of the harm, think that this is a high-income job, have participated in this evils (selling sex, brokering prostitution, prostitution).

- About legal policy

The legal system on prostitution prevention and control issued for more than 10 years has revealed certain limitations, no longer consistent with reality, has not yet met the requirements of fighting and preventing prostitution in the new situation. Specifically:

+ The current concept of prostitution does not cover new behaviors such as buying and selling sex among homosexual people; acts related to prostitution such as sexuality, pornography ... there is no sanction against the subject of the act, making it difficult for the authorities to organize the prevention and prevention of trade. sex in service business establishments.

+ Although determination of prevention is measure tfocus on prostitution prevention and control, however the Ordinance lacks provisions on conditions to ensure resources for implementation; competence to handle violations (the competence to revoke licenses and practice certificates of chairpersons of provincial and district-level People's Committees; sanctioning competence of the Social Evils Prevention and Control Sub-Department ..

+ HIV / AIDS transmission through unsafe sex, especially through sex workers, is very high. Meanwhile, there are no regulations on the implementation of HIV / AIDS harm reduction interventions in prostitution prevention and control interventions.

+ On handling violations: Lack of sanctions for administrative handling of violations such as: Pornography, sexual arousal; Some acts of high social danger such as organizing, sponsoring prostitution activities have not been defined as crimes in the Penal Code; disciplinary action against cadres, civil servants and people of the people's armed forces who violate the law on prostitution prevention and combat has not been strictly implemented according to regulations.

- Regarding supporting mechanisms and policies

The Law on handling of administrative violations, Resolution No. 24/2012 / NQ-QH13, stipulates that the measure of sending to medical establishments is not applied to sex workers but there is no supportive mechanism, policy or service consistent with the social characteristics of the sex workers in the community.

- About the intervention models

Intervention programs for sex workers are based on a new approach perspective (ensuring equity, emphasizing social support, promoting the right to access and use social security services. , creating opportunities for sex workers to change jobs ...) is still in the pilot phase, implementation is not synchronous, limited in resources, so the number of people accessing services is very small. Pilot time is short, not enough practical basis to develop appropriate policies and laws.

III. MAIN CONTENT OF THE PROGRAM

1. Perspectives, Goals

a) Perspectives
- Preventing prevention is the focus in the prevention and fight against prostitution. Pay attention to social measures to reduce the harm caused by prostitution to social life.

- Strengthen the building of institutions to protect human rights, increase the access of disadvantaged groups (sex workers, victims of trafficking for the purpose of prostitution) to the social security system.

- To step by step socialize, develop mechanisms and policies to mobilize the participation of community organizations and social institutions (families, schools ...) in prostitution prevention.

b) Objective
Create a strong change in awareness, raise the responsibility of all levels, sectors and the whole society in prostitution prevention and control; minimizing the harmful effects of prostitution on social life; ensure equal rights to access and use social services of sex workers; reduce crime related to prostitution.

2. Object, scope, execution time

a) Subjects
- Sex workers, victims of trafficking for the purpose of prostitution.

- Owners of conditional service businesses.

- Families with victims of trafficking for the purpose of prostitution.

- Ministries, branches, localities and units are assigned the task of implementing the Program activities.

b) Scope
The Program's activities are carried out nationwide, focusing mainly in urban areas and key cities and provinces on prostitution and human trafficking.

c) Implementation period: From 2016 to the end of 2020.

3. Specific Objectives and Tasks of the Program

a) Strengthen the propaganda, dissemination and education of the law and raise awareness about prostitution prevention and control

- Target:
+ By 2017, reaching 75% and by 2020 100% of communes, wards and townships (collectively referred to as commune level) organize at least one form of propaganda on prostitution prevention and regular maintenance.

+ From 2016, information on prostitution prevention and control has been posted on central and provincial press agencies at least once a month.

- Mission
+ Strengthen communication and prevention through direct propaganda activities in the community, concentrated in mountainous areas, poor localities, and localities with many migrants to limit new arising number of people participating in sex work:

. Develop communication tools, training materials for trainers and reporters (brochures, leaflets, posters, handbooks for communicators, calendars and reporters, movies ...) about prostitution prevention and combat; safe, healthy sexual behavior.

. Train the capacity building for the network of local reporters, communicators, volunteers and collaborators to effectively propagate and guide the community on prostitution prevention.

Diversifying forms of communication in the community through group discussions, direct or indirect counseling and support; highly interactive propaganda activities in industrial parks, schools ...; Focus on groups of peoplehigh prestige (students, students, unemployed workers, young women, teenagers, migrant workers in industrial zones, ... especially migrant workers, looking for jobs in other places) to ensure safe labor migration, in accordance with their capabilities and conditions.

c) Develop and implement harm reduction intervention activities to prevent the spread of social diseases and HIV / AIDS, prevent and reduce gender-based violence in prostitution prevention and control.

+ 50% of provinces and cities implement HIV / AIDS harm reduction interventions, prevention and reduction of gender-based violence in prostitution prevention and control.

+ By 2020: 20 provinces and cities will build models of providing social support services for sex workers.

- Mission

+ Implement HIV / AIDS harm reduction intervention activities, prevention and reduction of gender-based violence:

. Evaluate and document a number of pilot models that are effective in providing supportive services for harm reduction and reproductive health care in some localities to develop guidelines for implementation.

Organize training courses and capacity building on support for harm reduction and community integration for provincial agencies in charge of social evils prevention and combat, and staff directly involved in prostitution prevention and control. and officers directly involved in providing and supporting services for sex workers.

. To train and improve the capacity of the commune-level volunteer social work team in propagating, mobilizing, consulting and supporting sex workers in the community.

. Develop and test a support process and social support service package for sex workers in the community. Standardize the service conditions, standards and quality in the mechanism that the State mandates and orders non-public establishments to provide support services to sex workers.

. Develop mechanisms to mobilize the participation of social organizations, non-governmental organizations, community-based organizations (CBOs), clubs, self-help groups, peer groups to participate in activities. prevent, reduce harm, reduce discrimination, support community reintegration for sex workers.

+ Building and testing 03 models:

IV. ORGANIZATION OF PROGRAM IMPLEMENTATION

1. Program Operating Organization

a) At central level

- The Ministry of Labor, War Invalids and Social Affairs is the standing agency assisting the Government and the National Committee for AIDS and drug and prostitution prevention and control to implement the Program. Establishing an interdisciplinary working group on prostitution prevention and control to assist the Ministry of Labor, War Invalids and Social Affairs in organizing the program implementation.

b) Locally

2. Assignment of responsibilities

a) The Ministry of Labor, War Invalids and Social Affairs:

b) The Ministry of Public Security shall direct police forces at all levels to intensify activities to prevent and fight crimes related to prostitution; coordinate activities of prostitution prevention and combat with drug and human trafficking prevention and control; review, propose, amend and supplement regulations on security and order management for business establishments with security and order conditions; manage the area and handle violations related to prostitution prevention and control.
